Terms and Conditions

1. Subject Matter

These Terms and Conditions govern the Vespa 125 and e-bike rental service offered by Larioway, Italy. By completing a booking, the customer (hereinafter "Rider") fully accepts these terms.

2. Available Fleet

• Vespa 125 — 125 cc scooter, approved helmet + third-party liability insurance + delivery included.
• E-Bike MTB — front-suspension pedal-assist bicycle, range up to ~80 km, 250 W motor max 25 km/h. Available as half day (up to 4h) or full day.
• E-Bike City — city pedal-assist bicycle, luggage rack, comfort design. Available as half day (up to 4h) or full day.

Delivery is free of charge for addresses in Como and Cernobbio. For all other municipalities in the Lake Como area, a €15 delivery surcharge applies, charged automatically at checkout.

3. Rider Requirements

• Vespa 125: minimum age 21, valid driving licence category A1, A2, A or B. The licence must be presented at delivery. Larioway reserves the right to refuse the rental if the licence is expired, suspended or invalid. No refund will be issued in such cases.
• E-Bike MTB / E-Bike City: no licence required. E-bikes are classified as pedal-assist bicycles (max 25 km/h, 250 W). The Rider must comply with the Highway Code and local cycle-path regulations.
• The Rider declares that all information provided at booking is truthful. Providing false data results in immediate termination of the contract.

4. Booking and Payment

The booking is confirmed upon online payment. The price includes the vehicle, the stated accessories (helmet for Vespa, lock for e-bike), third-party liability insurance (Vespa only) and delivery/collection at the specified location.

Minimum rental: the minimum booking is half a day (up to 4h) for all vehicles, including the Vespa 125.

Operating hours: deliveries and collections take place between 08:00 and 19:00. Operations outside these hours are not guaranteed.

Security deposit: a security deposit is required at the time of physical handover (credit card pre-authorisation or cash):

• Vespa 125: €200.00
• E-Bike MTB / E-Bike City: €100.00

The deposit is released within 15 days of the vehicle's return, unless charges apply for damage, unreturned accessories, fines or other penalties set out in this contract.

5. Area of Use

The Vespa 125 is provided exclusively for use within the borders of Italy. E-bikes are provided for use in the Lake Como area and surroundings, within the Lombardy Region. Leaving the respective permitted area without prior written authorisation from Larioway is prohibited. Violation results in immediate termination of the contract and forfeiture of the entire security deposit. The Rider is also liable for all vehicle recovery costs.

Vehicles are equipped with a GPS system for safety and tracking in the event of theft or emergency.

6. Rider Obligations

• Use the vehicle with care and diligence, complying with the Highway Code and local regulations.
• Vespa: always wear the approved helmet provided. It is mandatory.
• E-Bike: a helmet is mandatory for riders under 14 and strongly recommended for all.
• Not to transfer the vehicle to third parties not named at booking.
• Not to ride under the influence of alcohol or drugs.
• Not to use the vehicle for competitions, races, paid transport or commercial activities.
• Not to modify the vehicle. Any tampering with the e-bike's electronic system (speed limiter, controller, motor) is strictly prohibited and results in a €200.00 charge plus repair costs, and may have criminal consequences.
• Return the vehicle in the same condition as received, clean and with the same fuel/battery level. An e-bike returned with a flat battery incurs a €5.00 charge.
• Traffic fines (restricted zones, speeding, parking) are the Rider's responsibility, with an additional €30.00 administrative fee per case handled by Larioway.

7. Cancellation and Refund

• More than 48h before start: full refund
• Between 24h and 48h before: 50% refund
• Less than 24h before: no refund

To cancel, write to support@larioway.com with your booking reference. Refunds are processed within 5–10 business days.

8. Insurance and Damage Liability

The Vespa 125 is covered by compulsory third-party liability insurance included in the price. Damage to the rented vehicle (comprehensive), theft and fire are not covered. The Rider is fully liable for any damage to the vehicle during the rental period, with a minimum excess of €500.00 per incident.

E-bikes are not covered by comprehensive insurance. The Rider is fully liable for damage caused during the rental at actual repair cost.

9. Accident Procedure

In the event of an accident, however minor, the Rider must contact Larioway as soon as possible and:

1. Not move the vehicle and, if necessary, alert the authorities.
2. Complete the accident report (European Accident Statement) with the other party. Do not admit liability.
3. Collect: details of all parties involved, witness information, photographs of the scene and damage.
4. Not arrange repairs without written authorisation from Larioway.

10. Theft and Loss

• In the event of theft, the Rider must file a police report within 24 hours and provide a copy to Larioway.
• E-bike: the Rider is always fully liable for the e-bike's full market value in the event of theft, regardless of whether anti-theft devices were used or a police report was filed.
• Vespa: the Rider is not liable for theft of the vehicle provided that all anti-theft devices supplied (lock, steering lock) were correctly used. Failure to use such devices makes the Rider fully liable for the vehicle's full market value.
• Loss or theft of keys/lock: replacement cost + €50.00 administrative fee (Vespa) / €50.00 (e-bike).

12. Delivery and Collection

We deliver the vehicle to the address specified at booking by the agreed time. Collection takes place at the same location or at an alternative address specified in the booking. Delays of more than 30 minutes attributable to the Rider may result in a reduction of the rental period with no proportional refund.

13. Limitation of Liability

Larioway is not liable for damage of any kind arising from accidents, theft, adverse weather conditions, force majeure or unforeseen events. Items left on the vehicle or accessories are considered abandoned. In the event of a mechanical failure not attributable to the Rider, Larioway will provide a replacement where possible, otherwise a refund for the unused rental period. Punctures or damage from improper use are the Rider's responsibility.

14. Governing Law and Jurisdiction

These Terms are governed by Italian law. Any dispute shall be subject to the exclusive jurisdiction of the Court of Como. A void or unenforceable clause shall not affect the validity of the remaining provisions.
